Terms of Use
Last Updated: July 8, 2009By using the HintCafe.com Website, you agree to be bound by these Terms of Use, whether or not you register as a member of HintCafe.com. If you wish to sign up and make use of the HintCafe.com service, please read these Terms of Use. If you object to anything in this Agreement do not use the Website. We reserve the right, at our sole discretion, to change or delete portions of these Terms at any time without further notice. Your use of the Service after such changes will constitute acceptance by you of the new terms.
Eligibility
You may not use this service if you are under 18. You must be above 18 and single or separated from your spouse to register as a member of HintCafe Events or use the Website.
Non-commercial Use by Members
The website and organized events are for the personal use of individual members only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become members and should not use the Service or the Website for any purpose without written consent from HintCafe. Illegal and/or unauthorized uses of the Website or Events, including collecting usernames, email addresses or any personal identifiable information of members may be investigated, and appropriate legal action will be taken.
User Content
By using or accessing HintCafe.com, you represent, warrant and agree that you will not post:
- User Content that violates the law or anyone's rights, including intellectual property ("IP") rights or other proprietary rights (such as rights of publicity and privacy);
- any Contact Information or private information of any third party;
- false, misleading or fraudulent information;
- any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer or telecommunications equipment;
- User Content that is threatening, hateful, racially or ethnically offensive, or that depicts nudity, pornography or graphic or gratuitous violence, or anything else that we may consider offensive.
- any telephone numbers, street addresses, URLs or email addresses.
By posting content to any area of HintCafe.com, you automatically grant, and you represent and warrant that you have the right to grant, to HintCafe.com and its affiliates an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, reproduce, adapt, modify and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the foregoing. You further represent and warrant that public posting and use of your content by HintCafe.com will not infringe or violate the rights of any third party.
Fees
You acknowledge that HintCafe.com reserves the right to charge for any portion of the website and to change its fees (if any) from time to time in its discretion. If HintCafe.com terminates your Membership because you have breached the Agreement, you shall not be entitled to the refund of any unused portion of fees or payments (if any).
Security
Your account is private and should not be used by anyone other than you. You are responsible for all usage or activity on the website by users using your password, including but not limited to use of your password by any third-party.
Indemnify
HINTCAFE DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF, OR OTHERWISE ENDORSE ANY INFORMATION CONTAINED ON HINTCAFE.COM. DUE TO THE NUMBER OF SOURCES FROM WHICH CONTENT DISTRIBUTED BY HINTCAFE IS OBTAINED, THERE MAYBE DELAYS, OMISSIONS OR INACCURACIES IN SUCH CONTENT. YOU ACKNOWLEDGE THAT USE OF THE SERVICE IS AT YOUR OWN RISK. WE DO NOT REPRESENT OR ENDORSE THE ACCURACY OR RELIABILITY OF ANY MEMBER PROFILE, ADVICE, OPINION, STATEMENT OR OTHER INFORMATION DISPLAYED, UPLOADED OR DISTRIBUTED THROUGH THE SERVICE BY HINTCAFE, OUR PARTNERS OR ANY USER OF THE SERVICE OR ANY OTHER PERSON OR ENTITY. YOU ACKNOWLEDGE THAT ANY RELIANCE UPON ANY SUCH OPINION, MEMBER PROFILE, ADVICE, STATEMENT OR INFORMATION SHALL BE AT YOUR SOLE RISK.
Although each member must agree to Our terms and conditions, We cannot guarantee that each member is at least the required minimum age, nor do We accept responsibility or liability for any content, communication or other use or access of the Service by persons under the age of 18 in violation of this Agreement. Also, it is possible that other members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials through the Service and that You may be involuntarily exposed to such offensive or obscene materials. It also is possible for others to obtain personal information about You due to Your use of the Service. Those others may use Your information for purposes other than what You intended. We are not responsible for the use of any personal information that You disclose on the Service. Please carefully select the type of information that You post on the Service or release to others.
You agree to indemnify and hold HintCafe.com, its subsidiaries, and affiliates, and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the HintCafe Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth in this Agreement and/or if any Content that you post on or through the HintCafe Services causes HintCafe to be liable to another. If you have a dispute with any HintCafe member, you agree to release HintCafe, its officers, affiliates and business partners from any claims, demands and damages of every kind and nature connected with such dispute.
Events Organization
HintCafe Events and affiliates associated with each event such as service providers, catering services, transportation services and any form of service that is necessary for operation of the event shall not be liable for any damage, loss, delay, injury, accident or irregularity to any event participant or her/his property that may result from any act or omission of any company, contractor, or employee of those providing services in connection with HintCafe events. Furthermore, HintCafe nor it's affiliates can be held responsible for delays or cancellations that result from bad weather, road connections, breakdowns, strikes or other circumstances. In the event that an event is cancelled, participants may qualify for a full refund, but under no circumstance will HintCafe pay in excess to the amount paid by participant minus expenses for the services already rendered. HintCafe and/or its affiliates are not responsible for breach of contract or any intentional or careless actions or omissions on the part of the event coordinators/tour operators and/or service providers, or other services used or obtained on or at the time of the event, trip or program, which result in any loss, damage, delay or injury to you or your travel companions or group participants.
Events - Code of Conduct
Each member that attends a HintCafe event is required to comply by a code of conduct. Failure to comply with the code of conduct may result in refusal of service and/or may be banned from HintCafe.com and/or asked to leave the event. If a participant breaks the code of conduct and are asked to leave or are refused service, the participant will forfeit the amount paid for the service. There will be no refunds, no exceptions. The following lists a partial list for Code of Conduct. The final decision to determine Code of Conduct and definition of appropriate behavior lies solely with HintCafe.
- You will dress appropriately for attending HintCafe Events
- Obscene, profane language, physical abuse or fighting will not be tolerated.
- HintCafe events require minimal instructions to follow. You shall follow the instructions of events coordinator
- You shall not cause any damage to personal or private property.
Expectations
HintCafe.com and HintCafe events provide a fun and exciting way to meet people. HintCafe does not guarantee that a participant will successfully match with another participant or will meet with anyone at an event. HintCafe does not guarantee that using HintCafe.com website or events will result in introductions or actual dates.
Copyright
The website contains information which is proprietary to us, our partners, and our users. We assert full copyright protection of such information. Information posted by us, our partners or users of the Service is protected. You agree not to modify, copy or distribute any such information in any manner whatsoever without having first received the express written permission of HintCafe.com.
Service uptime
You acknowledge that we are not responsible for suspension of the Service, regardless of the cause of the interruption of HintCafe.com.
Termination
All decisions regarding the termination of accounts shall be made in the sole discretion of HintCafe.com. HintCafe.com is not required to provide you notice prior to terminating your membership. Even after your membership or subscription is terminated, this Agreement will remain in effect.
Prohibited Activities
The following is a partial list of the type of actions that you may not engage in with respect to the HintCafe.com website or HintCafe events:
- You will not impersonate any person or entity.
- You will not "stalk" or otherwise harass any person.
- You will not express or imply that any statements you make are endorsed by HintCafe without our specific prior written consent.
- You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
- You will not interfere with or disrupt the Services or the site or the servers or networks connected to the Services or the site.
- You will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service.
- You will not "frame" or "mirror" any part of the Website, without prior written authorization from HintCafe.com.
- You will not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the website or any software used on or for the Service or cause others to do so.
